A domestic violence accusation moves fast. Police can arrest you the same night, and a protective order can put you out of your own home, often before you have spoken to a lawyer. You need to know what happens to your kids, your job, and your gun rights and you need a plan for what comes next.
Haddad & Timmons Law Firm is a Cypress criminal defense lawyer team led by former prosecutors. We fight to take cases to dismissal or to a not guilty verdict at trial, and we know what a Harris County judge and prosecutor look for before that happens.
Tell us what’s happened so far and we’ll talk you through what it means for you and what your next step could be.

We defend Cypress clients against a range of charges that all carry the family violence label and all follow you differently once the case is over. This includes:

A family violence conviction does not stay in the courtroom. It can follow you into custody hearings, background checks, and gun ownership for the rest of your life. It may damage your reputation.
Under Texas Penal Code Section 22.01, a first family violence charge is usually a Class A misdemeanor, but it becomes a third-degree felony if you have a prior family violence conviction.
Many Cypress family violence arrests come with an emergency protective order the same day. Violating it, even by texting the protected person once, is a separate crime under Texas Penal Code Section 25.07. It becomes a third-degree felony if you have two or more prior convictions for violating a protective order. It can also become a third-degree felony if you violate the order by committing an assault or the offense of stalking against the protected person. A separate, lower-level felony can apply in narrower circumstances involving certain protective orders issued after a related sexual assault, stalking, or trafficking conviction.
Every case is different and no result is guaranteed, but recent Harris County and Fort Bend County outcomes give you a real sense of what is possible in some cases. Here is how three recent family violence matters ended for our clients.
| Outcome | Case Type |
| Case Dismissed | Assault Family or Household Member, Harris County (2026) |
| Case Dismissed | Threat Against a Family or Household Member, Harris County (2026) |
| Full Acquittal, Not Guilty Jury Verdict | Assault Causing Bodily Injury, Family Violence, Fort Bend County (2026) |
Prior case results do not guarantee a similar outcome in other cases.
It will unless the case is dismissed, reduced to a charge without a family violence finding, or you are found not guilty at trial. A family violence finding also follows you into custody and professional licensing matters long after the criminal case is closed.
Not until the order allows it, even if your name is on the lease or the mortgage. Violating it, even once, is a separate criminal charge under Texas Penal Code Section 25.07. A first violation is usually charged as its own Class A misdemeanor. It can turn into a felony in some situations.
A family violence conviction can cost you the right to own a firearm under both Texas and federal law, and that restriction often lasts well beyond your case. We review this consequence with every client during the first conversation about their charge.
Almost always. Family courts routinely ask about pending or past family violence charges, and even a charge that was later dismissed can come up in a custody hearing if it was not handled carefully the first time.
Your first appearance is usually a bond hearing, not a trial, and the judge decides the conditions you have to follow until the case is resolved. We prepare every client for exactly what will be asked that day and what conditions are realistic to request, so nothing about it catches you off guard.
If your question is not listed here, tell us the specifics of your charge and we will answer it directly.
