What a Cypress Aggravated Assault Charge Means ?

You do not need a law degree to know that being accused of seriously hurting someone, or using a weapon during a fight, gets treated very differently than an ordinary scuffle. You already know you are in trouble.

What you need to know now is what happens next. Could this follow you into your next job, your lease, or a custody hearing? What can you do about it before your first court date? Do you need a Cypress criminal defense lawyer?

Aggravated assault is a felony in Texas. How your file looks in the first few weeks often decides where things end up. Haddad & Timmons Law Firm is a Cypress aggravated assault lawyer team built by two former Harris County prosecutors, and that background shapes how the firm reads a case file from day one.

We use our experience to find the weak point in the evidence early. Tell us what happened and where things stand, and our Cypress assault lawyers will lay out your options going forward.

The Aggravated Assault Cases We Defend for Cypress Clients

We represent Cypress-area clients across the full range of aggravated assault charges, including:

  • Aggravated assault causing serious bodily injury: charges built on how serious someone’s injuries turned out to be, not just how the fight started.
  • Aggravated assault with a deadly weapon: cases involving a firearm, knife, or anything else prosecutors argue could have caused serious harm.
  • Aggravated assault against a family or household member: charges that carry extra penalties, protective order conditions, and closer prosecutor attention.
  • Aggravated assault against a public servant: charges involving police officers or other officials.
  • Aggravated assault by threat: cases where no one was actually touched, but someone displayed or used a weapon while threatening the other person, even though no one was hurt.

Whichever version of this charge you are facing, the facts of your specific case decide what happens next, not the label written on the police report.

Possible Penalties for a Harris County Felony Conviction

A conviction here is not like a misdemeanor conviction. Under Texas Penal Code § 22.02, most aggravated assault charges are second-degree felonies. Some aggravated assault cases become first-degree felonies instead of second-degree. This happens if the person used a deadly weapon and caused serious injury to a spouse, family member, or someone they were dating. It can also happen if the assault was committed by a public servant, or against someone the person knew was a public servant doing their job — a weapon is not required in that second situation.

Texas Penal Code § 12.33 sets that second-degree range at 2 to 20 years in prison and up to $10,000 in fines, with even higher penalties for a first-degree charge. A conviction can also cost you your right to own a firearm, and it can affect your immigration status if you are not a citizen.

Bond conditions can also restrict where you live and who you can contact while the case is pending. A felony record follows you into background checks too, which can affect jobs and housing for years after your case closes.

Cypress Aggravated Assault Questions We Answer

Do I need a lawyer right now, or can this wait?

Yes, there are benefits to talking to a lawyer now. Harris County moves fast on felony filings, and decisions made at your bond hearing and first court setting can shape the rest of your case.

I was arrested for aggravated assault in Cypress. What court will handle my case?

Cypress is not its own city, so there is no separate Cypress courthouse. Harris County Precinct 4 and Precinct 5 Constables and the Harris County Sheriff’s Office handle arrests in the area. The case itself moves to Harris County’s felony District Courts at the Harris County Criminal Justice Center in downtown Houston.

What is the difference between assault and aggravated assault?

Assault becomes aggravated when someone suffers serious bodily injury, or a deadly weapon gets used or displayed during the incident. A regular assault charge can turn into a felony aggravated assault charge based on an injury or a weapon, even when no one meant for things to go that far.

How much does an aggravated assault lawyer cost?

It depends on how far your case goes and how much evidence needs review. We can give you a clear number after an initial case review, once we know what you are actually facing.

How long will my Harris County aggravated assault case take?

Most felony cases move through several court settings before they resolve, and timelines depend on the court’s docket and how the evidence holds up. Simple cases can wrap up in a few months. Cases that go to trial often take a year or more.

If my case gets dismissed, will it still show up on a background check?

Yes, in most cases, unless you get the record expunged. For a dismissed case, Texas usually requires you to either wait until the time limit for charging that offense has passed, or show the case was dismissed for a specific legal reason, before you can expunge it. Sealing (called an order of nondisclosure) is a different process that mostly applies to deferred adjudication cases, not straight dismissals. We can tell you which option actually fits your situation.
